heatm.app is a privacy-friendly heatmap analytics service that provides:

  • Website user behavior tracking and visualization
  • Heatmap generation showing user interaction patterns
  • Analytics dashboards and reporting tools
  • User session recording and analysis
  • Performance insights and optimization recommendations

The Service is provided on a subscription basis with various pricing tiers and features.

3. User Accounts

3.1 Account Creation

  • You must provide accurate and complete information when creating an account
  • You are responsible for maintaining the confidentiality of your account credentials
  • You must be at least 13 years old to create an account
  • One person or entity may not maintain multiple accounts

3.2 Account Responsibilities

  • You are responsible for all activities that occur under your account
  • You must notify us immediately of any unauthorized use of your account
  • You may not transfer your account to another party without our consent
  • We reserve the right to suspend or terminate accounts that violate these Terms

4. Acceptable Use Policy

5. Payments and Billing

5.1 Subscription Fees

  • Subscription fees are billed in advance on a monthly or annual basis
  • All fees are non-refundable except as required by law
  • We may change pricing with 30 days' notice to existing subscribers
  • Payment is processed through Stripe, a third-party payment processor

5.2 Billing and Renewal

  • Subscriptions automatically renew unless cancelled before the renewal date
  • You may cancel your subscription at any time through your account settings
  • Cancellation takes effect at the end of the current billing period
  • We may suspend service for non-payment after reasonable notice

5.3 Refunds

Refunds are provided only in exceptional circumstances and at our sole discretion. We may offer refunds for:

  • Service outages lasting more than 24 hours
  • Billing errors on our part
  • Other circumstances as required by applicable law

6. Fair Use Policy

6.1 Unlimited Sessions

While we offer "unlimited sessions" as part of our service, this is subject to fair use. Our service is designed to accommodate normal website traffic and usage patterns. Excessive usage that significantly exceeds typical usage patterns may be subject to throttling or suspension.

6.2 Excessive Usage

We consider usage to be excessive when it:

  • Exceeds 10 times the average usage of similar websites on our platform
  • Shows patterns consistent with automated bots or abuse
  • Results in infrastructure costs that exceed reasonable thresholds
  • Violates the intended use of the service

6.3 Throttling and Suspension

If we detect excessive usage, we may:

  • Throttle your service to reduce usage to reasonable levels
  • Suspend your account temporarily or permanently
  • Contact you to discuss upgrading to a higher plan
  • Take other measures necessary to protect our infrastructure

6.4 Rate Limits

To ensure fair usage, we implement rate limits based on your subscription plan:

  • Starter Plan: Up to 500,000 events per day
  • Pro Plan: Up to 2,000,000 events per day
  • Trial: Up to 100,000 events per day

These limits are designed to accommodate normal usage while preventing abuse. If you need higher limits, please contact us to discuss upgrading your plan.

6.5 Appeals

If you believe your account has been incorrectly throttled or suspended, please contact us at support@heatm.app with details about your usage patterns. We will review your case and may restore full access if the usage is determined to be legitimate.

7. Intellectual Property Rights

6.1 Our Intellectual Property

The Service and its original content, features, and functionality are owned by Slickful Group LLC and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

6.2 Your Data

You retain ownership of your website data and content. By using the Service, you grant us a limited license to:

  • Process and analyze your data to provide the Service
  • Store your data securely on our systems
  • Generate reports and insights based on your data

6.3 Feedback

Any feedback, comments, or suggestions you provide regarding the Service may be used by us without any obligation to compensate you.

8. Privacy and Data Protection

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL SLICKFUL GROUP LLC BE LIABLE FOR:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, data, use, goodwill, or other intangible losses
  • Damages resulting from your use or inability to use the Service
  • Any conduct or content of any third party on the Service

Our total liability to you for any damages shall not exceed the amount you paid us in the 12 months preceding the claim.

You may terminate your account at any time by cancelling your subscription through your account settings or by contacting us.

10.2 Termination by Us

We may terminate or suspend your account immediately, without prior notice, for:

  • Violation of these Terms
  • Fraudulent or illegal activity
  • Non-payment of fees
  • Any other reason at our sole discretion

10.3 Effect of Termination

Upon termination, your right to use the Service ceases immediately. We may delete your account and data after a reasonable period, subject to our data retention policies.

11. Governing Law and Dispute Resolution

11.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to conflict of law principles.

11.2 Dispute Resolution

Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.
